1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the ExamSimplify mobile application ("App") and website at examsimplify.com ("Website"), operated by ExamSimplify ("we", "our", "us").

By creating an account or using our services, you confirm that you are at least 13 years of age and agree to be bound by these Terms. If you are under 18, you confirm that you have obtained parental or guardian consent.

2. Description of Service

ExamSimplify is an educational technology platform that provides:

• Access to past examination questions for JAMB UTME, WAEC SSCE, NECO, NDA and professional certifications
• Answer explanations and study tools
• Timed mock examinations
• Progress tracking and score analytics
• Additional learning tools including dictionary and calculator

3. User Accounts

3.1 Account Creation

To access most features, you must create an account. You agree to provide accurate, current and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You must notify us immediately at support@examsimplify.com if you suspect any unauthorised use of your account.

3.3 One Account Per User

Each user may only maintain one account. Creating multiple accounts to circumvent restrictions or subscription limits is prohibited and may result in account termination.

4. Subscription Plans and Payments

4.1 Free Plan

A limited free tier is available providing access to 40 fixed questions per subject with basic features. No payment is required for the free plan.

4.2 Paid Subscriptions

Premium subscription plans are available with enhanced features. By purchasing a subscription you agree to:

• Pay the applicable fees as described at the time of purchase
• All prices are in Nigerian Naira (NGN) unless otherwise stated
• Payments are processed securely by Paystack
• Subscriptions begin immediately upon successful payment

4.3 Refund Policy

Due to the digital nature of our content, we do not offer refunds once a subscription has been activated and content has been accessed. If you experience technical issues preventing access to the service, please contact support@examsimplify.com within 48 hours of purchase.

4.4 Subscription Expiry

Subscriptions expire on the date shown at purchase. Upon expiry your account will revert to the free plan. We do not automatically renew subscriptions without your explicit consent.

4.5 Family Plans

Family plan subscriptions allow up to 3 sibling accounts under one parent subscription. Each sibling must be a genuine family member. Misuse of family plans to provide access to unrelated users is prohibited.

5. Acceptable Use

You agree to use ExamSimplify only for lawful purposes. You must not:

• Share your account credentials with others (except under family plan arrangements)
• Attempt to circumvent subscription restrictions by technical means
• Copy, reproduce, distribute or create derivative works from our content without permission
• Use the App to cheat in actual examinations
• Reverse engineer, decompile or attempt to extract the source code of the App
• Upload or transmit viruses, malware or other harmful code
• Attempt to gain unauthorised access to our systems or other users' accounts
• Use automated tools, bots or scrapers to access or collect content from the App
• Harass, abuse or harm other users
• Use the service for any commercial purpose without our written consent

6. Intellectual Property

6.1 Our Content

The ExamSimplify App, Website, and all content including past questions, explanations, graphics, logos, icons and software are owned by ExamSimplify or our licensors and are protected by intellectual property laws.

6.2 Past Examination Questions

Past examination questions are sourced from publicly available examination records. ExamSimplify claims no ownership of the original examination questions but does own the curation, organisation, explanation content and presentation of these questions within the App.

6.3 Licence to Use

We grant you a limited, non-exclusive, non-transferable licence to access and use the App for your personal, non-commercial educational purposes. This licence does not include the right to reproduce, distribute, sell or create derivative works from our content.

7. Disclaimer of Warranties

ExamSimplify is provided "as is" without warranties of any kind. We do not guarantee:

• That the App will be available at all times or free from errors
• That past questions accurately reflect future examination content
• Specific score improvements or examination success
• That explanations are free from errors (though we work hard to ensure accuracy)

While we strive for accuracy in all content, past questions and explanations are provided for educational purposes and should be used as a study aid alongside official examination preparation materials.

8. Limitation of Liability

To the maximum extent permitted by law, ExamSimplify shall not be liable for:

• Any indirect, incidental, special or consequential damages
• Loss of data or inability to access the App
• Any examination results, whether positive or negative
• Decisions made based on content in the App

Our total liability to you for any claim shall not exceed the amount you paid for your subscription in the 12 months preceding the claim.

9. Privacy

Your use of ExamSimplify is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our collection and use of your data as described in the Privacy Policy.

10. Termination

10.1 Termination by You

You may stop using the App at any time. To delete your account, contact us at support@examsimplify.com. Account deletion does not entitle you to a refund of any subscription fees paid.

10.2 Termination by Us

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. We will provide notice where reasonably practicable.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through a notice in the App. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your rights as a consumer under applicable local law.
